Under Section 74 of the ESI Act , E.I. Courts are constituted in such local area in the state as may be specified in the notification issued by the State Govt. in the official Gazette.
       
 
As per the provisions of different Section 75 to Section 78 of the ESI Act 1948, the Court mainly decides the matters related to question or dispute arises between I.P. & Corporation, Employer & Corporation, Employer & I.P. etc, with regard to interpretation of section 2 (9)/2 (22) etc. of the ESI Act. The important features reg. presecution being launched & more details etc. are specified under section 75(1)(a) to (g) & 75 (2)(a) to (e) in ESI Act 1948.
  Criminal Courts
 
 
Criminal Cases are filed against employers as well as insured persons under section 84 of the ESI Act in r/o wrong declaration cases, false statement, employees etc. information given by employers/IPs.
 
  Under Section 85(a) for non. payment of contribution.
 
  Under Section 85(e) (g) for non submission of returns of contribution etc.
 
 
Criminal Cases are filled under section 85(g) against employers in r/o non submission of accident report, Form-01, Declaration forms non production, of records vouchers ledgers etc.
       
    Criminal Cases are filed under section 85(A) for repeated offence against employers/IPs/Employers.
       
  Criminal Cases are filed by the ESI Corporation in The Criminal Court Situated at :
    Court Of Chief Metropolitan Magistrate, Gheekanta, Mirjapur, Ahmedabad.
       
 
 
Court Of Chief Indicial Magistrate, Situated at Himatnagar, Kalol, Kadi, Mehsana, Rajkot, Wankaner, Jamnagar, Junagadh, Morbi, Bhavnagar etc.
       
  Criminal Cases Under Oher Sections
       
 
 
Criminal Cases are filed against employer under section 406/409 Indian Penal Code for non payment of Court in r/o employees share (which are deducted but not deposited)
       
 
 
Criminal Cases are files under section 138 of NI Act, 1881, against employers in r/o dishonoured cheques received from the banks.
